In most states, during a domestic incident , the State (Police Department) is the entity that would be pressing the charges, even if the victim didn’t want to. This method takes away the option of a victim being too scared to press charges. For instance, a battered woman who knows her significant other will cause more harm to her if she calls the police on him, will likely not report the assault or will say she doesn’t want him arrested if the police show up. The police are mandated to make the arrest if they are related or in a sexual relationship.
On the other hand, if a man walks over to his female neighbors house and punches her in the head, she has the choice to press charges or not to press charges.
In either situation, if arrested, the perp could make bail and be out the next day. That’s a different problem

It's probably down to the perps state of mind. Stalking someone home shows intent. Slapping someone mid argument can be argued as an outburst which is no intent.

It would be ridiculous if it was accurate, but it's not. He got charged with domestic violence because that's what they feel they can confidently prove at this early juncture, right now. More serious charges often come later, when prosecutors have a more complete picture of how strong the case for higher charges will be.
Jumping straight to charges that are a more difficult case to make in court is a great way to lose the case and cause the guy to get off Scot free. The goal here is to WIN.

Attempted murder is such a bullshit charge. The intent was there and should be punished just like an actual murder. People shouldn't be given leniency because they failed to finish the job. If a person is willing to go that far they are a murderer in my eyes and should rot in prison.
One of the most common rationales I've heard for it is actually kind of related to your point. If they know that the charge is the same there is absolutely no inclination to ever NOT finish the job.
Keep in mind attempted murder has a very large scope of actions.

It's not a movie, it can take up to 5 mins to do brain damage. I was put to sleep in a comp a couple of weeks ago, I have also put others to sleep that didn't tap.
I thought that surely meant intent to kill too, from checking elsewhere it looks like it requires a significant amount of time beyond unconsciousness for cellular death to occur from the lack of oxygen. I guess attempted murder would have to be a very long hold while unconscious (e.g., a whole minute+). Still, the way he dropped her could've killed her if she smacked her head on the concrete.
Hopefully the active charges are enough for a sentence of near permanence but I'm doubtful.
Charges can increase if and when more evidence is presented. From my understanding, they like to charge a suspect for minimum to get an arrest warrant.

It's amazing how black and white some people think the justice system and due process is.
They always book for the lesser charges and will later decide to press more serious charges. This is because the lesser the charge is typically the less evidence you need to charge them and hold them where you can take your time building evidence for more serious charges.

"Attempted murder" is a Hollywood and newsfotainment phrase. A lot of state codes don't use that phrase and instead use different degrees of assault and battery. My mom was stabbed in the neck repeatedly in her own home by a stranger. She survived. The perpetrator was charged with various counts and degrees of assault and the biggest charge was "kidnapping". That's a serious charge in most states and doesn't just mean someone holding you hostage. If a perp makes you go anywhere you don't want to go through violence or strength or threat, that can be considered kidnapping.
Strangulation is not automatically classified as attempted murder, but it can be if it was their intention.

Killing via strangulation requires maintaining the hold for a long time too. Longer than you think. Movies and tv never get it right. Rendering someone unconscious like this happens much sooner than death. This plays a role in determining charges and guilt at trial. The key question is what was his intent.
I served in a jury trial once that involved death via strangulation and this was all explained to us. A medical examiner came in and explained that the suspect killed the victim intentionally via strangulation by gripping his throat for several minutes to ensure death and his self defense claim was therefore BS. We found him guilty of second degree murder. He is still in prison today.
Murder means intent. You've gotta prove that. Not always easy.

I was a victims advocate for domestic violence victims so basically most of my job was convincing women to leave men like this and prosecute them. I say it's about a 20/80 split 80% of victims showing up to the first hearing to get the automatic no contact order revoked to take them back...and ive definitely seen worse than this girl got (not to diminish her pain at all) I had one gal who i thought had been sliced with a knife on her back, small petite lady, the dude beat her so bad it broke the skin and you could see her ribs.... got a felony assault charge, no attempted murder, guilty on all charges, 6 months in jail....women don't matter.

In college I was roommates with a dude who had a full ride through football. He was dumb as rocks, violent, and a serial cheater/abuser. He eventually got kicked out for continuing to break the law. One of my other dorm mates was also on the team with a full ride. Literally the biggest and nicest guy I’d ever met. It was so fucking weird.
One probably had loving parents. Not to absolve the other because lots of people come from broken homes and shitty situations and become great and successful good people. But that probably has a lot to do with it
